DA calls for action after court ruling on Illegal Land Occupations in Setsoto

The Democratic Alliance (DA) is deeply concerned by the Setsoto Municipality’s failure to act against ongoing illegal land invasions, which have escalated since 2023 due to a lack of action. These invasions threaten township development, delay housing allocations, and harm law-abiding residents on waiting lists.

Alarming allegations suggest some political parties are encouraging land grabs for support, exploiting vulnerable residents, and dividing communities. Despite repeated DA calls, the municipality stalled, ignoring a legal opinion of 6 September 2024 that advised filing for eviction. Instead, it waited for another judgement.

On 15 August 2025, the Free State High Court confirmed the municipality’s legal position, dismissing the occupants’ appeal with costs and affirming that the land was illegally occupied, unsuitable for habitation, and not taken by homeless people. The court ruled the eviction as just and equitable.

With the judgement delivered, excuses for inaction no longer exist. Yet, the municipality has failed to outline a plan. The DA stresses the urgent need for fair housing but insists it must follow lawful processes.

We call on the Setsoto Municipality to:

  • Act immediately on the ruling and file eviction applications.
  • Provide a clear action plan to the DA and community.
  • Ensure transparent and lawful housing processes.
  • Hold accountable those encouraging illegal occupations.

The time for excuses has passed; the community deserves action.
